Change in the Supervisory Board at H&R WASAG AG

Salzbergen, Germany, 4 November 2010

Osnabrück Local Court (Amtsgericht) has appointed Mr Roland Chmiel and Dr Rolf Schwedhelm as new members of the Supervisory Board at H&R WASAG AG with immediate effect on 28 October 2010. Mr Chmiel and Dr Schwedhelm are succeeding Mr Eckbert von Bohlen und Halbach and Mr Günther Papenburg, who resigned from their posts for personal reasons effective from 9 October 2010 and 1 October 2010 respectively.

Mr Roland Chmiel is an auditor and member of the partnership Weiss-Walter-Fischer-Zernin in Munich, and has many years of experience in advising medium-sized and large, also listed, companies. Mr Chmiel is a member of the Supervisory Board at Togal Werk AG, Munich.

Dr Rolf Schwedhelm is a lawyer specialising in tax law and a partner in the law firm Streck Mack Schwedhelm in Cologne. His activities are focused mainly on advice and representation in the fields of company law, tax law and legal issues relating to fiscal offences. Dr Schwedhelm is Chairman of the Supervisory Board at DeutscheAnwaltAkademie Gesellschaft für Aus- und Fortbildung sowie Serviceleistungen mbH, Berlin.

The appointment of these two members complies with the recommendation in Item 5.4.1 of the German Corporate Governance Code with regard to supervisory board members being appropriately qualified.

Mr Eckbert von Bohlen und Halbach and Mr Günther Papenburg will continue to be closely associated with the company and are being appointed as honorary members of the Supervisory Board of H&R WASAG AG.
